Philip Morris hit with record 300 million dollar fine PDF Print E-mail

A Florida jury ordered tobacco giant Philip Morris Thursday to pay $300 million in damages to a former smoker -- the largest fine ever in such a case. Ex-smoker Cindy Naugle suffers from severe emphysema. Naugle’s attorney Robert Kelley said: "Philip Morris refused to accept any responsibility for her emphysema, even though she was an addicted customer for 25 years." Murray Garnick, a Philip Morris lawyer said: "We believe that the punitive damages award is grossly excessive and a clear violation of constitutional and state law." Naugle's lawsuit was one of thousands the Supreme Court ruled in 2006 could be filed individually, but not as part of a class action suit. Some 4,000 similar claims are pending in federal court. Naugle gave up smoking in 1993 but developed severe respiratory problems and cannot walk more than a few steps without becoming breathless. Source
